Guitar Genie Specialist Community Terms & Conditions

These Terms and Conditions apply to individuals and businesses that submit their details to join, are welcomed into, or participate in the Guitar Genie Specialist Community. The Specialist Community is intended for people participating in connection with their trade, profession or business. It is not a consumer service.

1. About Guitar Genie

In these Terms:

“Guitar Genie”, “we”, “us” and “our” mean Guitar Genie Ltd.
“Member”, “you” and “your” mean an individual or business participating in the Specialist Community.
“Specialist Community” means the private professional community organised by Guitar Genie, including any associated Facebook group, Discord server or other online or offline community space.
“Community Content” means messages, posts, photographs, files, documents, technical information and other material shared within the Specialist Community.

2. Purpose of the Specialist Community

The Specialist Community exists to help independent guitar technicians, luthiers, amplifier engineers, touring technicians and other repair specialists: share technical knowledge and experience; discuss unusual faults and difficult repairs; seek second opinions; identify rare, unusual or discontinued components; recommend tools, parts, suppliers and resources; discuss workshop practices and business challenges; build trusted professional relationships; support others working within the trade; and preserve useful specialist knowledge. The Specialist Community is intended to encourage collaboration and constructive professional discussion. Membership is free unless Guitar Genie expressly agrees a different arrangement with you in writing.

3. Independent status

Members remain completely independent from Guitar Genie and from one another. Membership does not make you: an employee or worker of Guitar Genie; an agent or representative of Guitar Genie; a franchisee of Guitar Genie; a partner in Guitar Genie; a subcontractor engaged by Guitar Genie; or a person authorised to enter into agreements on behalf of Guitar Genie. You remain responsible for your own: business; services and workmanship; prices and contractual terms; tools, equipment and premises; insurance; tax affairs; employees and contractors; customer relationships; data protection obligations; and legal and regulatory compliance. You must not represent that you work for Guitar Genie or are authorised to bind Guitar Genie.

4. Joining the community

Guitar Genie may review the details submitted by people wishing to join the Specialist Community. We may take into account matters including: the services you provide; your experience and specialist knowledge; your professional background; your connection to the guitar, instrument or electronics repair trade; your conduct and communication; and whether your participation appears consistent with the purpose of the community. Guitar Genie may welcome or decline prospective members at its discretion. Membership does not amount to formal accreditation, certification or a guarantee by Guitar Genie of a member’s services.

5. Community participation

Members are expected to participate professionally, respectfully and constructively. You must not use the Specialist Community to: harass, threaten, bully or abuse another person; discriminate unlawfully; deliberately provoke or disrupt discussions; post spam or irrelevant promotional material; impersonate another person or business; make knowingly false or misleading statements; disclose confidential or personal information unlawfully; promote illegal activity; distribute malware or harmful material; or use the community in a way that could reasonably damage its safety or purpose. Disagreement is permitted. Personal attacks are not.

6. Technical discussions and advice

Members may discuss repairs, fault-finding, components, tools, techniques and other technical subjects. Community discussions are informal exchanges between independent professionals. They are not formal instructions, certifications or guarantees from Guitar Genie. Guitar Genie does not verify every technical statement made by members and does not guarantee that Community Content is complete, accurate or suitable for a particular repair. You remain responsible for: assessing any advice or information before relying on it; confirming that a proposed method is appropriate; working within your own competence; carrying out your own safety checks; complying with manufacturer guidance and applicable law; and deciding whether you should accept or continue a particular job. You must not rely solely on a community post where independent verification, testing or specialist expertise would reasonably be required. This is particularly important for work involving mains electricity, valve amplifiers, stored electrical charge, hazardous substances, structural modifications or other potentially dangerous activities.

7. Sharing repair information

Members may share notes, observations, photographs and information from repairs where they are entitled to do so. Before sharing information, you should remove or obscure unnecessary personal or identifying details. You must not share: customer contact details; full names where they are unnecessary; addresses; payment details; private correspondence; serial numbers where they could identify a customer or valuable item unnecessarily; confidential commercial information; or photographs containing identifiable personal information unless you have a lawful and appropriate reason to do so. Where a photograph of an instrument, workshop or component contains identifying information, you should crop, blur or remove it before posting where reasonably possible.

8. Rare components, parts and materials

Members may use the Specialist Community to identify, locate, exchange or discuss unusual components, tools, parts and materials. Any sale, purchase, loan, exchange or transfer agreed between members is a separate arrangement between those members. Guitar Genie is not a party to that arrangement and does not guarantee: the condition of an item; its description; its authenticity; compatibility; delivery; payment; legality; or suitability for a particular purpose. Members should carry out their own checks before purchasing, selling, fitting or relying on a component or material.

9. Difficult customer situations

Members may seek professional advice about situations involving customers, including: unpaid invoices; failure to collect instruments or equipment; unreasonable expectations; abusive or threatening communication; disputes about quotations or additional work; complaints; suspected fraud; boundary-setting; and other difficult business situations. These discussions must remain factual, proportionate and focused on seeking constructive advice. You must not use the Specialist Community to: create or contribute to a customer blacklist; publicly or privately “name and shame” a customer; encourage harassment or retaliation; publish allegations as fact without proper grounds; share unnecessary personal information; make defamatory statements; or expose another person to an unreasonable risk of harm. Where possible, difficult customer situations should be discussed anonymously. If you believe there is a serious and immediate risk involving fraud, theft, violence or safety, you should report the matter to the appropriate authority. You may also raise the issue privately with a community administrator where it directly affects the safety of the community.

10. Confidentiality and private discussions

The Specialist Community is intended to provide a trusted space for professional discussion. You must not reproduce, screenshot, forward, publish or distribute another member’s identifiable Community Content outside the community without their permission, unless disclosure is required by law or reasonably necessary to report unlawful or dangerous conduct. General technical knowledge learned through discussion may be applied in your own work. However, you must respect: confidential information; copyright; trade secrets; personal information; unpublished commercial information; and any express request that particular material is not shared further. Membership does not give you permission to copy another member’s photographs, documents, written guides, branding or original materials.

11. Intellectual property

Members retain ownership of original content they create and share. By posting Community Content, you give Guitar Genie a limited, non-exclusive permission to host, display, copy and process that content as reasonably necessary to operate, moderate and administer the Specialist Community. This permission does not allow Guitar Genie to sell your original content or use it in public marketing without further permission, except where the content has already been made public by you or its use is otherwise permitted by law. You must only post material that: you own; you have permission to share; or you are otherwise legally entitled to use.

12. Member-to-member relationships

Members may independently: collaborate; seek second opinions; exchange components; refer customers to one another; arrange subcontracting; share workshop facilities; or enter into other professional arrangements. Any such arrangement is made directly between the relevant members. Guitar Genie does not supervise, control or guarantee these arrangements and is not responsible for the conduct, payment, workmanship or obligations of the members involved. Members should agree any important commercial terms directly and in writing where appropriate.

13. Customer work

Membership does not make Guitar Genie responsible for work carried out by a member. Each member remains responsible for: deciding what work to accept; assessing their competence; agreeing scope and prices; obtaining customer authority; caring for customer property; carrying out services with appropriate care and skill; invoicing and collecting payment; resolving complaints; and complying with applicable consumer and business law. The Specialist Community does not provide insurance, legal protection or a guarantee covering a member’s work.

14. Data protection

Members are responsible for complying with the data protection laws that apply to their own businesses and activities. You must take reasonable steps to keep personal information secure. Personal information obtained through the Specialist Community must not be: sold; scraped; added to marketing lists without an appropriate lawful basis; used to contact members or customers for unrelated purposes; or disclosed unlawfully. Guitar Genie is responsible for its own processing of member information in accordance with its Privacy Policy.

15. Promotion and commercial posts

The Specialist Community should not become dominated by advertising. Members may share relevant information about: useful products; specialist services; components; tools; events; training; and professional opportunities where this is helpful to the community. Guitar Genie may limit or remove repetitive, misleading, irrelevant or excessive promotional posts. Paid promotions, supplier advertising or organised commercial activity within the community require Guitar Genie’s prior agreement.

16. Supplier offers and community benefits

Guitar Genie may occasionally arrange optional benefits for members, including: supplier discounts; affiliate offers ;product demonstrations; training opportunities; events; competitions; resources; or other professional benefits. Availability is not guaranteed and may change. Third-party suppliers remain responsible for their own :products; prices; terms; discounts; warranties; fulfilment; and customer service. Guitar Genie may receive an affiliate commission, sponsorship payment or other commercial benefit from some third-party arrangements. Where appropriate, this will be made clear. Participation in any third-party offer is optional.

17. Separate paid services

Guitar Genie may offer separate paid services in future, such as: advertising or marketing support; software; training; events; business resources; supplier arrangements; or other commercial services. Membership of the Specialist Community does not require you to purchase any paid service. Any separate paid service may be governed by its own terms and pricing.

18. Use of the Guitar Genie name

Membership does not give you an unrestricted right to use the Guitar Genie name, logo or branding. You may accurately state that you are a member of the Guitar Genie Specialist Community while your membership remains active. You must not describe yourself as: approved by Guitar Genie; accredited by Guitar Genie; certified by Guitar Genie; employed by Guitar Genie; an official Guitar Genie repairer; or formally recommended or guaranteed by Guitar Genie unless Guitar Genie has given you specific written permission to use that wording. You must stop using any Guitar Genie branding or membership description if your membership ends or Guitar Genie reasonably asks you to stop.

19. Community administration and moderation

Guitar Genie may appoint administrators or moderators to help manage the Specialist Community. Administrators may: provide guidance; move or close discussions; remove inappropriate content; ask members to amend posts; restrict participation; issue warnings; temporarily suspend members; or remove members. Moderation decisions are made to protect the purpose, safety and usefulness of the community. Guitar Genie is not obliged to monitor every discussion or approve every post before publication.

20. Reporting concerns

Members should report content or conduct that appears: abusive; threatening; fraudulent; unlawful; unsafe; seriously misleading; in breach of confidentiality; or inconsistent with these Terms. Reports should be made privately to Guitar Genie or a community administrator. Reports must be made honestly and must not be used to harass another member or manipulate a professional disagreement.

21. Suspension or removal

Guitar Genie may suspend or end a person’s membership where it reasonably considers this appropriate. Reasons may include: serious or repeated breach of these Terms; harassment or abusive conduct; unlawful sharing of personal information; misuse of confidential Community Content; knowingly false or misleading statements; inappropriate commercial promotion; conduct that makes the community unsafe; misuse of Guitar Genie branding; dishonest or unlawful conduct; or behaviour that materially undermines the purpose of the community. Serious conduct may result in immediate removal. Where reasonably practicable, Guitar Genie may explain the reason for a suspension or removal, but it is not required to continue a professional relationship indefinitely.

22. Leaving the community

You may leave the Specialist Community at any time. Leaving does not remove responsibilities that arose before your membership ended, including obligations relating to: confidentiality; personal information; intellectual property; separate agreements with other members; or unlawful conduct. After leaving, you must not continue to present yourself as a current member.

23. Availability of the community

Guitar Genie may change, suspend or discontinue any community platform or feature. We do not guarantee: uninterrupted access; continued availability of a particular platform; preservation of every post or file; participation by any particular member; or that every question will receive a response. Members should retain their own copies of information that is important to their businesses.

24. Responsibility and liability

Each member remains responsible for their own decisions, conduct, business and professional work. To the extent permitted by law, Guitar Genie is not responsible for losses arising solely from: advice or information supplied by another member; a member’s decision to rely on Community Content; an arrangement between members; a transaction between members; work carried out by a member; third-party supplier products or services; loss of access to a community platform; or content removed during moderation. Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

25. Changes to these Terms

Guitar Genie may update these Terms from time to time. Where a change materially affects membership, Guitar Genie may notify members using the contact details provided or through an announcement within the Specialist Community. The updated Terms will apply from the effective date stated in the new version. Material changes will not normally apply retrospectively to events that occurred before the updated Terms came into effect.

26. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction over disputes concerning these Terms, subject to any mandatory legal rights that apply.

27. Acceptance

By submitting your details to join the Specialist Community; ticking the relevant acceptance box; accepting an invitation to participate after receiving these Terms; or continuing to participate after being notified of these Terms, you confirm that you have read and agree to them. Existing members moving from the former Recommended Specialist arrangements should be asked to accept Version 2.0 expressly.
